In his landmark monograph, "The Politics of Jesus", John Howard Yoder challenged mainstream Christian social ethics by arguing that the New Testament account of Jesus's founding of a messianic community entails a normative politics, not only for early Christianity but for the contemporary church. This challenge is further elaborated in several important posthumous publications, especially "Preface to Theology", in which Yoder examines the development of early Christology with attention to its political and ethical implications, and "The Jewish-Christian Schism Revisited", Yoder's (...) proposal for a renewed Jewish-Christian dialogue around the moral meaning of messianism. This article interprets these writings with reference to a range of critical scholarship on and about Yoder, Yoder and Augustine, and Jewish and Christian messianism, paying particular attention to questions of political ethics. Nick Joaquin, one of the Philippines’ pillars of literature in English, is regrettably known locally for his nostalgic take on the Hispanic aspect of Philippine culture. While Joaquin did spend a great deal of time creatively exploring the Philippines’ Hispanic past, he certainly did not do so simply because of nostalgia. As recent studies have shown, Joaquin’s classic techniques that often echo the Hispanic influence on Philippine culture may also be considered as a form of resistance against both the American (...) neocolonial influence and the nativist brand of nationalism in the 1950s and 1960s. Despite the emergence of Gothic criticism in postcolonial writing, Joaquin’s works have rarely received the attention they deserve in this critical area. In this context, this paper explores the idea of the Gothic in Joaquin’s writing and how it relates to Joaquin being the “most original voice in postcolonial Philippine writing.” In 1972, the University of Queensland Press featured Joaquin’s works in its Asian and Pacific writing series. This “new” collection, Tropical Gothic, contained his significant early works published in Prose and Poems plus his novellas. This collection’s title highlights a specific aspect of Joaquin’s writing, that of his propensity to use Gothic tropes such as the blending of the real and the fantastic, or the tragic and the comic, as shown in most of the stories in the collection. In particular, I examine how his novella interrogates the neurosis of the nation—a disconnection from the past and its repercussions on the present/future of the Philippines. (shrink)

This article focuses on two possible missions for a national bioethics commission. The first is handling differences of worldview, political orientation, and discipline. Recent work in political philosophy emphasizes regard for the dignity of difference manifested in "conversation" that seeks understanding rather than agreement. The President's Council on Bioethics gets a mixed review in this area. The second is experimenting with prophetic bioethics. "Prophetic bioethics" is a term coined by Daniel Callahan to describe an alternative to compromise-seeking "regulatory bioethics." It (...) involves a critique of modern medicine. In the contemporary context, the areas of biotechnology and access to health care cry out for prophetic attention. The Council has addressed biotechnology; unfortunately, that experience suggests that the kind of prophecy that it practices poses risks to conversation. With regard to access issues, the article proposes an effort that unites themes of human dignity, solidarity, and limits in support of reform, while highlighting, rather than papering over, differences. Despite the abolition of the transatlantic slave trade, slavery is not confined to the past. Many forms of slavery exist worldwide today, as highlighted by increased recent awareness of trafficking. International, and some national, legislation to combat contemporary slavery and trafficking exists, yet these practices continue. As important as legislation is its effective and sensitive implementation. With trafficking, we need to recognise the complexities of forced labour within a global context and move policy beyond its current restricted and potentially harmful (...) focus on immigration. This includes providing support for those leaving forced labour and generating a thorough understanding of causal factors in order to reduce future vulnerability. (shrink)

The “born this way” narrative remains a popular way to defend nonnormative genders and sexualities in the United States. While feminist and queer theorists have critiqued the narrative's implicit ahistorical and essentialist understanding of sexuality, the narrative's incorporation by the state as a way to regulate gender identity has gone largely underdeveloped. I argue that transgender accounts of this narrative reorient it amid questions of temporality, race, colonialism, and the nation-state, thereby allowing for a critique that does justice to (...) the enmeshment of categories of difference. The 1987 Cartwright Report into events at New Zealand’s National Women’s Hospital catalysed sweeping changes to promote and protect patients’ rights. A generation on, it is comfortable to believe that such sustained and deliberate violations of patient rights “couldn’t happen here” and “couldn’t happen now.” And yet, contemporary examples beg a different truth. Three of Cartwright’s messages hold an enduring relevance for health practitioners and patients: the need for patients to be respected as people; to be supported to make informed (...) choices; and to have their voices heard, even when they whisper. These challenges cannot be met in isolation from broader determinants of patients’ rights and will require social, technological, and cultural change in order to prevent another “unfortunate experiment.”. By and large, neither bioethicists nor economists have offered a satisfactory account of how managed care organizations should ration health care. Both disciplines would like to guarantee adequate care to all without defining adequacy. But it cannot be done. The more we rely on market forces to distribute health care, the more we need a national standard of care.

Few works have had the impact on contemporary philosophy exerted by Hegel's Phenomenology of Spirit. Twentieth-century philosophers in France were bound together by a reading of Hyppolite's translation and commentary. Sartre, Merleau-Ponty, Lacan, and Bataille were all shaped by Kojève's lectures on the book. Late twentieth-century philosophers such as Derrida, Lyotard, Deleuze, and Irigaray all operate against a Hegelian horizon. Similarly, in Germany Heidegger, Adorno, and Habermas developed their philosophies in large part through an engagement with Hegel. In the United (...) States the book has had a profound influence on feminism and gender studies. Thinkers as diverse as Butler, Benhabib, Mills, and Honig have developed political theories as well as theories of sexual difference by rereading Hegel's reading of Antigone. As Derrida suggests, this text must be read. It lays out the infrastructures and architectures of life in the modern nation state. It unfolds a grand narrative of the ways of thinking and acting that comprise human experience in "our time." The purpose of the text is to effect a transformation in readers, so that they cease to think of themselves as particular humans and come to know that their existence inheres in membership in a complex community-social, cultural, economic, religious, aesthetic, and political infrastructures that form the culture of possibilities in which self-consciousness emerges and is sustained. Rawlinson's reading reveals how Hegel's politics of the "we" is undermined both by his effacement of sexual difference and by his misappropriation of art as a "betrayal of substance." Both of these gestures discount specificity in favor of a generic subject and a mutual recognition in which the other is the same. She uses Hegel's own critique of abstraction against him to rethink the "we" as a community of difference, figured materially in the differentiated styles or signatures of art, and in so doing argues that that the task of phenomenology is never completed and that the abstract concepts of logic will always be dependent on phenomenology's productive or generative movement. In her reading Hegel is neither a metaphysician nor a subjective idealist. He is a phenomenologist, analyzing experience to articulate the ways in which humans generate narratives and material infrastructures to sustain the complexities of life. (shrink)

Nurses’ duties and patients’ rights have been important foci in nursing. Nurses’ rights legitimate the power and responsibility of the profession. There are few published articles on this subject in the nursing science literature. This article is a theoretical examination of nurses’ rights that aims to structure (i.e. show the internal logic of) those that have been little studied. It is based on the philosophical literature and published research. Nurses’ rights can be divided into: human and civil rights, rights based (...) on health care legislation, professional rights, and earned rights. In this context, professional rights relate to nursing and also to tasks shared with other health care professions. Analyzing nurses’ rights will help to promote these rights, improve nurses’ position both nationally and internationally, and provide possibilities for enhancing patient care. (shrink)

In Canada, there are currently no guidelines at either the federal or provincial level regarding the provision of kidney transplantation services to foreign nationals (FN). Renal transplant centres have, in the past, agreed to put refugee claimants and other FNs on the renal transplant waiting list, in part, because these patients (refugee claimants) had health insurance through the Interim Federal Health Programme to cover the costs of medication and hospital care. However, severe cuts recently made to this programme have forced (...) clinicians to question whether they should continue with transplants for FNs, for financial and ethical reasons. This paper first examines different national policies (eg, in Canada, USA, France and the UK) to map the diversity of approaches regarding transplantation for FNs, and then works through different considerations commonly used to support or oppose the provision of organs to these patients: (1) the organ shortage; (2) the free-rider problem; (3) the risk of becoming a transplant destination; (4) the impact on organ donation rates; (5) physicians’ duties; (6) economic concerns; (7) vulnerability. Using a Canadian case as a focus, and generalising through a review of various national policies, we analyse the arguments for and against transplantation for FNs with a view to bringing clarity to what is a sensitive political and clinical management issue. Our aim is to help transplant centres, clinicians and ethicists reflect on the merits of possible options, and the rationales behind them. (shrink)

Born with a rare genetic disease, severe combined immune deficiency (SCID), Ashanti lacked a healthy immune system and was extremely vulnerable to infection. Children with SCID usually develop overwhelming infections and rarely survive to adulthood; even a (...) common childhood illness like chicken pox is life-threatening. Ashanti led a cloistered existence, avoiding contact with people outside her family, remaining in the sterile environment of her home, and battling frequent illnesses with massive amounts of antibiotics.In Ashanti's gene therapy procedure, her own white blood cells were genetically modified and then infused back into her bloodstream. Laboratory tests show that the therapy has strengthened Ashanti's immune system. She no longer has recurrent colds, has been allowed to attend school, and has been immunized against whooping cough. This gene therapy procedure is not a cure, however. The genetically-treated white blood cells only survive for a few months and must then be replaced, but Ashanti's future is much brighter because of the new therapy (VI, Thompson [The First] 1993).Although this simplified description of Ashanti's gene therapy procedure sounds like a happy ending, it is little more than an optimistic chapter in a long story. The road to the first approved gene therapy procedure was rocky and fraught with controversy. The biology of human gene therapy is very complex, and there are still many techniques that need to be developed and diseases that need to be understood more fully before gene therapy is well established. The public policy debate surrounding the possible use of genetically engineered material in human subjects is equally complex. Major participants in the debate come from the fields of biology, government, law, medicine, philosophy, politics, and religion, each bringing different views to the discussion.In studying the ethics of gene therapy, one should draw a distinction between [End Page 63] therapy on somatic (non-reproductive) cells and germ (reproductive) cells. Only the germ cells carry the genes that will be passed on to the next generation. Reactions to gene therapy have varied widely. Some commentators on gene therapy object to any form of genetic manipulation, no matter how well-intentioned (VI, Rifkin 1983). Another reaction is to allow the use of somatic-cell therapy, but not to approve the use of germ-line therapy, which could have unforeseeable effects on future generations. A different stance is that, with proper regulation and safeguards, germ-line gene therapy is a logical extension of the progress made to date and that it is an ethically acceptable procedure.TechniquesTo date, 43 research protocols have been approved for somatic-cell gene therapy in the United States. The techniques employed in each protocol vary, but in general a virus is used as a "vector" to insert the desired gene into the DNA of the patient's cells, in order to compensate for a defective gene. For Ashanti's gene therapy, this technique involved obtaining white blood cells and introducing properly functioning genes into as many of the cells as possible. The normal genes were delivered through the use of a specially-engineered virus.Although similar techniques are used in germ-line gene therapy, the procedure is more difficult. There are two basic ways to perform germ-line gene therapy: (1) to treat a preimplantation embryo that carries a serious genetic defect before its implantation in the mother, which necessitates the use of in vitro fertilization techniques; or (2) to treat the germ cells (sperm or egg cells) of afflicted adults so that the genetic defects would not be passed on to their offspring, which requires the technical expertise to delete the defective gene and insert a properly functioning replacement. This article addresses a telling issue in academic science: the clarity of criteria for tenure and promotion reported by women and men faculty in scientific fields. Data from faculty surveyed in nine US research universities point to ways that formal and informal organizational indicators predict the clarity of evaluation reported by women and men. Unexpected patterns occur by gender. Among men, both formal and informal organizational indicators, as well as field, predict their reported clarity of evaluation. Among women, however, only (...) informal organizational indicators, namely, frequency of speaking with faculty about research and departmental climate, are significant predictors. Further, overall, informal indicators are stronger predictors of clarity than are formal indicators, and some field differences occur. En Europe, la recolonisation progressive des territoires par les grands carnivores, espèces protégées, fait l’objet de conflits virulents notamment dus à l’impact des actes de prédation sur les activités d’élevage. Les conflits provoqués par le retour du loup en France ont été abondamment relayés par la presse et ont ainsi été diffusés auprès d’un public élargi. À travers une mobilisation conjointe de méthodes de la lexicométrie et de l’analyse du discours, nous avons étudié l’évolution de l’image médiatique de l’éleveur dans (...) la presse régionale (Nice-Matin) et nationale (Le Monde) entre 1993 – date de première médiatisation du retour du loup – et 2014. Notre recherche témoigne d’une construction axiologique de cet acteur dans les deux quotidiens considérés. Tout au long de la période, Nice-Matin opère une légitimation de l’éleveur à travers la valorisation de son témoignage et de la profession qu’il exerce. La posture du quotidien national évolue quant à elle au cours du temps. Les premières années (1993-1999) sont marquées par un discours évaluant négativement la parole de l’éleveur et favorisant l’expertise institutionnelle. À partir du début des années 2000, marquées d’un point de vue institutionnel par l’autorisation de tirs de prélèvement dérogatoires de loups, Le Monde établit progressivement une image positive de l’éleveur et développe un discours empathique proche de celui de la presse régionale. These magazines had the potential to become important voices in the professionalizing debate because of their national distribution. This study reveals that although journalists remained divided over the value of professionalism, they valued Editor & Publisher more than The Journalist because Editor & Publisher took a leadership role on the professionalism debate, defining professionalism and explaining what standards and group norms were expected from professional journalists. The 1995 U.S. Catholic bishops' statement "Moral Principles and Policy Priorities on Welfare Reform" makes an important contribution to the welfare policy discussion and to the development of welfare ethics, particularly as the Personal Responsibility and Work Opportunity Reconciliation Act of August 1996 is implemented at the state level throughout the nation. Their statement, however, is weakened by lack of attention to critical analysis of political economy. Such analysis challenges the central assumption driving United States welfare reform and has (...) the potential to enhance Catholic welfare ethics. By examining the radical restructuring of work, rising corporate subsidies, and the ideological function of welfare, the author supports the bishops' policy goals while she expands the moral principles at stake and redefines the scope of the problem. This chapter explores normative conceptions of citizenship and their implications for moral and civic education. Starting with an account of the historical emergence of Republican and Liberal conceptions of citizenship, it notes important conceptual links between notions of citizenship and agency, democracy, general will formation, political authority and legitimacy, rights and duties, and moral and political standing. Against this historical background, it then turns to a discussion of the cognitive and affective capacities that these notions of citizenship involve, and the (...) role of education in the development of citizens. Contemporary analyses and controversies, such as the role of national identity and the role of educational institutions as sites for developing civic knowledge and dispositions, are outlined. This paper describes the significance of key empirical findings from the recent and landmark study Caring and Aging with Pride: The National Health, Aging and Sexuality Study (with Karen I. Fredriksen‐Goldsen as the principal investigator), on lesbian, gay, bisexual, and transgender aging and health disparities. We will illustrate these findings with select quotations from study participants and show how nonconscious bias (i.e., activation of negative stereotypes outside conscious awareness) in the clinical encounter and health care setting can threaten shared decision‐making (...) and perpetuate health disparities among LGBT older adults. We recognize that clinical ethicists are not immune from nonconscious bias but maintain that they are well situated to recognize bias and resulting injustice by virtue of their training. Further, we discuss how clinical ethicists can influence the organization's ethical culture and environment to improve the quality and acceptability of health care for LGBT older adults. (shrink)

The multitude of training models and curricula for the specialty of clinical neuropsychology around the world has led to organized activities to develop a framework of core competencies to ensure sufficient expertise among entry-level professionals in the field. The Standing Committee on Clinical Neuropsychology of the European Federation of Psychologists’ Associations is currently working toward developing a specialty certification in clinical neuropsychology to establish a cross-national standard against which to measure levels of equivalency and uniformity in competence and service provision (...) among professionals in the field. Through structured interviews with experts from 28 European countries, we explored potential areas of core competency. Specifically, questions pertained to the perceived importance of a series of foundational, functional, and other competencies, as well as current training standards and practices, and optimal standards. Our findings revealed considerable agreement on academic and clinical training, despite varied actual training requirements currently, with fewer respondents relegating importance to training in teaching, supervision, and research, and even fewer to skills related to management, administration, and advocacy. European expert clinical neuropsychologists were in agreement with previous studies regarding the importance of sound theoretical and clinical training but management, administrative, and advocacy skills were not central to their perspective of a competent specialist in clinical neuropsychology. Establishing a specialty certificate in clinical neuropsychology based on core competencies may enable mobility of clinical neuropsychologists across Europe, and, perhaps, provide an impetus for countries with limited criteria to reconsider their training requirements and harmonize their standards with others. The traditional Christian teaching is that engaging in sexual activity, whether heterosexual or homosexual, outside the marriage of one man and one woman is sinful. In direct contrast, there are those in the Church who quite recently have begun to insist that the traditional teachings concerning sexual sin need to be changed. In particular, the effort is being made to have the Church accept homosexual behavior as not sinful or problematic in any way—at least not for committed homosexuals, as comparable (...) to committed heterosexuals in a marriage. As we all know, this relatively recent view has been promoted heavily in the media and popular culture, and even by our national government. As we make our observations, we will particularly focus on traditional Orthodox Christianity as the fullness of the truth and, thus, the source of the true alternative to this “new” outlook that is gripping much of popular Western culture today. In this article, I respond to queer critiques of the pursuit of same-sex marriage. I first examine the issue of normalization through a consideration of the everyday lives of same-sex couples with children, a subject about which queer critics are strangely silent. Children force same-sex couples to be out in multiple areas of their lives and recent court cases explicitly challenge the idea that same-sex couples do not make fit parents. Second, I examine whether same-sex marriage will address structural inequalities (...) or will mainly benefit white, middle-class people. Access to marriage has disparate benefits depending on people’s structural locations, but is a movement goal supported by a broad array of LGBT people. Third, I examine the relationship between marriage, regulation, and the state. I argue for a broader understanding of the relationship between the state and different types of relationships, suggesting that it is impossible to escape regulation. If we consider marriage and family forms cross-nationally, we see a variety of possibilities for state recognition of various family forms. I conclude by assessing the impact of same-sex marriage on the future of LGBT politics, arguing that achieving marriage equality may allow the space for new political possibilities to emerge. This essay investigates technical aspects of the history of aviation in the Republic of China, focusing on the period between 1920 and 1937. It suggests that Chinese authors and administrators came to see the establishment of technical infrastructure as dependent on the education of personnel who could assume responsibility for maintaining and expanding Chinese aviation ventures, rather than on specific technologies or practices. Magazines and journals in the 1920s reflected concerns with the establishment of weather observation and reporting, radio communications, (...) and technical education in service of aviation; the last of these was critical for the first two. Provisions for technical work and training were reflected in contracts that were drawn up in the years around 1930 to establish three aviation projects in the Republic: the China National Aviation Corporation (CNAC), the Eurasia Aviation Corporation, and Southwest Airlines. Subsequent contracts and reports for CNAC and Eurasia in the years before the 1937 outbreak of war with Japan suggested a particular emphasis on the technical education of personnel as an important step in building Chinese aviation infrastructures. Little is known about how certain patient characteristics can affect the timing of an ethics consultation, which has been hypothesized to affect patient length of stay. This study assessed how specific patient characteristics affect the timing of an ethics consultation, namely, age (over 65 years), race, Medicaid status, the presence of a living will, the presence of a health care proxy, and the absence of decisional capacity. Moving beyond the typical case-series evaluation of an ethics consultation service, this study used (...) an innovative approach to model how predisposing, enabling, and need factors affect health behavior and subsequently affect health outcomes for patients who received an ethics consultation at a Catholic health care system in Oklahoma. Liana Badr's The Eye of the Mirror explores the historical trauma of the 1975–6 siege of the Palestinian refugee camp Tal el–Zaatar in Beirut and the massacre of thousands of its inhabitants by Christian militias. Analogous to Holocaust writing, Badr's fictionalized history, grounded in actual survivor testimonies, enacts a complex politics of cultural memory, but does so from a specifically female perspective. Collapsing the personal and political, private and public, inside and outside through figured violations of bodies and psyches, Badr (...) repositions women at the centre of the Palestinians’ struggle for and story of survival. Badr's novel traces the annihilation of the possibility of address, accompanied by self–loss and the ability to witness, and the laborious recreation of address. Claiming authority on the basis of the emotional, visceral truth of suffering, she seeks to break the endless cycle of an oppressive and impotent masculine history, constructing an alternative history which at least attempts to address the voice of cultural, national, and gender difference. Our paper explores several factors related to the relatively small percentage of women managers in organizations in Japan (especially in comparison to otherindustrialized nations) and examines the strategies of several major corporations that have incorporated diversity management into their corporate social responsibility programs to address problems of gender equity.

Background In 2001 a report on the provision of clinical ethics support in UK healthcare institutions identified 20 clinical ethics committees. Since then there has been no systematic evaluation or documentation of their work at a national level. Recent national surveys of clinical ethics services in other countries have identified wide variation in practice and scope of activities. Objective To describe the current provision of ethics support in the UK and its development since 2001. Method A postal/electronic questionnaire survey administered (...) to the chairs of all 82 clinical ethics services registered with the UK Clinical Ethics Network in July 2010. Results Response rate was 62% with the majority of responding services situated in acute trusts. All services included a clinical ethics committee with one service also having a clinical ethicist. Lay members were present in 72% of responding committees. Individual case consultation has increased since 2001 with 29% of chairs spending more than 50% of their time on this. Access to and involvement in the process of case consultation is less for patients and families than for clinical staff. There is wide variation in committee processes and levels of institutional support. Over half of the responding committees undertook some form of evaluation. Conclusion Clinical ethics services in the UK are increasing as is their involvement in case consultation. However, the significant variation in committee processes suggests that further qualitative research is needed to understand how these committees function and the role they play in their institution. The part anger plays in motivating political action is frequently noted, but less is said about ways in which anger continues to be a part of how people do politics. This article critically assesses approaches to emotions that emphasize managing anger in accordance with ‘feeling rules’. It reflects on the utility of Marxist notions of conflict as the engine of change for the understanding of how anger operates in political life. This involves understanding the ambivalence of anger and its operation (...) within particular power relations. Shifting sets of conventions have had some continuity in discouraging women in Western nations (particularly white and middle-class women) from showing anger. But clearly, women do get angry and feminists have drawn on anger in acting politically. New Zealand feminist writings from the ‘second wave’ are taken as illustrative of the common difficulties Western feminists faced in dealing with anger. These difficulties were due to trying to juggle social conventions about femininity, the political ideal of sisterhood, and the realities of dealing with other women in often new and experimental political processes. Anger could be personalized and hurtful, but in certain cases its expression was constructive in producing more respectful relations. Exploring these cases makes it clear how anger produces, and is produced by, relations with others. (shrink)

The U.S. Centers for Disease Control and Prevention (CDC 2015) estimates that 35 percent of American adults are obese, while 69 percent are overweight. The CDC also estimates that nearly one in every five children in the United States is obese. The National Bureau of Economic Research estimates that medical treatments of obesity cost US$168.4 billion a year, or 16.5 percent of national spending on medical care (Cawley and Meyerhoefer 2010). Public Health England (n.d.) estimates that 25 percent of the (...) adult population in England is considered obese, while 62 percent of adults are overweight. The World Health Organization (WHO) estimates that in North America, large portions of Central and South America, most of Europe, Russia, and Australia, 60 percent of the population is overweight. The United States and the United Arab Emirates have the highest obesity rates, according to the WHO, at 32.6 and 33.8 percent, respectively. The rest of North America, those large portions of Central and South America, Europe, Russia, and Australia exhibit rates over 20 percent (WHO n.d.). (shrink)

Genetic modification of trees has the potential to change our forests forever, yet there has been little publicly available information or debate on this important topic. Ethical analysis of genetic modification of plants to date has been focussed mainly on food and feed crops and pharmaceutical production. The purpose of this paper is to examine one major ethical issue arising in connection with the genetic modification of trees, the necessity to examine the practice in its full scientific, social, economic, political (...) and environmental context. It is argued that if this is not done, important factors that play a role in a through ethical critique will be overlooked. The analysis focuses mainly on the Canadian situation, but there are implications for other timber-producing nations as well. The paper concludes that a thorough ethical critique must take into account the ends for which biotechnology is being pursued. (shrink)
